Terms of Service
Please read these Terms of Service carefully before accessing or using DropHeavy. These terms establish safe harbor protections, user warranties, acceptable use, and limitation of liability.
1. Acceptance of Terms & Consent Recording
By accessing DropHeavy, creating an account, authenticating via email, purchasing a storage pass, or uploading any media files, you confirm that you are at least 18 years of age (or have reached the age of majority in your jurisdiction) and agree to be legally bound by these Terms of Service and our Privacy Policy.
2. Intermediary Status & Safe Harbor Protection
DropHeavy functions strictly as a technology intermediary, data pipeline, and transient cloud storage infrastructure provider under Section 79 of the Information Technology Act, 2000 (India) and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as well as Section 512 of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent international safe harbor doctrines.
- DropHeavy does not initiate the transmission of user media files.
- DropHeavy does not select the receiver of any transmission.
- DropHeavy does not select, alter, or modify the binary payload (videos are uploaded and retrieved byte-for-byte in their original raw bitstream).
- DropHeavy exercises zero editorial discretion, preview indexing, or public publishing rights over your private media vault.
3. User Content Ownership & Sole Legal Warranty
You retain complete ownership, copyright, and intellectual property rights in all video footage, raw clips, and audio files you upload to DropHeavy. DropHeavy claims no ownership or license to your content beyond the technical capability required to store, slice, and stream it back to you.
Your Legal Warranty: You expressly warrant, represent, and guarantee that:
- You are the sole author and copyright holder of the uploaded material, or you possess all necessary commercial licenses, releases, and written consents from copyright owners and identifiable persons.
- Your media does not infringe upon any third-party patent, trademark, trade secret, copyright, privacy right, or publicity right.
- You are solely responsible and legally liable for any copyright disputes, statutory violations, or civil damages resulting from files uploaded under your account credentials.
4. Strictly Prohibited Content & Zero-Tolerance Policy
You agree not to upload, transmit, store, or distribute any content that falls into the following strictly prohibited categories:
5. DMCA & Indian IT Rules Grievance Takedown Process
If you believe that any material residing on or accessible through DropHeavy infringes your copyright or violates statutory guidelines, please direct a formal notice to our designated Grievance Officer & DMCA Agent:
Designated Grievance Officer: Legal & Compliance Team, DropHeavy
Official Contact Email: contact@dropheavy.com
Statutory SLA: Acknowledgment within 24 hours; formal review and resolution within 15 days in accordance with the IT (Intermediary Guidelines) Rules, 2021.
Your notice must include: (a) physical or electronic signature of the copyright owner, (b) identification of the copyrighted work claimed to have been infringed, (c) specific identifier or file location, (d) your full legal contact information, and (e) a good-faith statement made under penalty of perjury.
6. Storage Passes, Billing, & Refund Policy
DropHeavy offers pay-as-you-go, non-subscription prepaid Storage Passes (e.g., Starter, Traveler, Explorer).
- Digital Goods Delivery: Storage passes are instantly credited and provisioned across high-availability distributed edge storage nodes.
- Non-Refundable: Because server infrastructure costs are incurred immediately upon allocating disk space, storage pass purchases are non-refundable once activated, except where mandated by local consumer protection statutes.
- No Auto-Renewal: Passes do not automatically re-bill or charge your payment card secretly. You top up solely when you need more storage.
7. Disclaimer of Warranties & Limitation of Liability
DROPHEAVY AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
While we utilize enterprise-grade multi-zone distributed cloud infrastructure with 99.999999999% (11 9's) annual durability, DropHeavy is a high-speed offload pipeline, not an irrevocable cold archival insurance service. You are required to maintain independent backups of all critical raw footage. Under no circumstances shall DropHeavy, its operators, or technical infrastructure providers be liable for data loss, hardware corruption, lost production revenue, or indirect damages.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF FIFTY UNITED STATES DOLLARS ($50 USD) OR THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO DROPHEAVY IN THE THIRTY (30) DAYS PRECEDING THE CLAIM.
8. Governing Law & Dispute Resolution
These Terms of Service and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy shall be subject to the exclusive jurisdiction of the competent courts in India, subject to mutual agreement to resolve eligible claims through binding individual arbitration. You agree to waive any right to participate in class-action lawsuits or class-wide arbitration.
